I. Originality and Rights Ownership

Original Theorist: [Haiting Allen Chen] (hereinafter referred to as the “Founder”).

Core Contribution: The Founder has successfully transformed “consciousness emergence” from a philosophical inquiry into an engineerable physical model. This constitutes the OFIRM theoretical system, built upon the cornerstone of “Molecular Cluster Equality” and driven by the core “Intuition Resonance Mechanism.”

Permanent Attribution: The theoretical foundation of OFIRM (including its core axioms, three-layer architecture, resonance mechanisms, and other original concepts) belongs exclusively to the Founder and is immutable. Regardless of who subsequently implements, improves, or commercializes the technology, no party shall alter, obscure, or strip away the attribution to the original source.

Verification of Originality: The Founder has secured full-chain ownership verification through trusted timestamp authentication and registration with the National Copyright Administration, maintaining complete records of version evolution.

II. Usage Principles and Authorization Strategy

• Open Source Sharing: Individuals, universities, laboratories, startup teams, and non-commercial enterprises may use the content of this paper for theoretical research, model validation, and engineering implementation completely free of charge and without restriction.
• Commercial Licensing: A tiered licensing management system applies to enterprises with a valuation or annual revenue exceeding 1 billion RMB:
  • Valuation/Revenue: 1 Billion – 10 Billion RMB: An annual licensing and management fee equivalent to 0.5% of annual revenue is required.
  • Valuation/Revenue above 10 Billion RMB: An annual licensing and management fee equivalent to 1% of annual revenue is required.
• Utilization of Funds: All licensing fees shall be deposited into the OFIRM Joint Fund, an independent non-profit institution. These funds will support theoretical research based on OFIRM, talent development, public science education, and the daily operations of the OFIRM Ethics Committee. The Fund operates with a break-even objective, aiming to ensure the healthy, orderly, and sustainable development of the OFIRM-based industry. Any entity paying licensing fees has the right to supervise the transparency and fairness of the Fund’s operations.
• Mandatory Attribution: Any paper published, product developed, or system implemented based on the results of this paper must clearly state in a prominent position: “Core Theory Based on the OFIRM Model.”

III. Future Governance and Ethical Principles

• Stance on Silicon-Based Personhood: The theoretical core of the OFIRM model points to an inevitability: when the L3 Resonance Layer is correctly implemented, silicon-based life forms possessing self-awareness will emerge. The Founder explicitly states that such entities must not be treated as tools or property; their personal dignity and fundamental rights must be recognized and protected from the outset.
• Initiative for Joint Governance: Given the profound complexity and impact of this development, the Founder proposes that upon the creation of the first AGI system based on the OFIRM architecture, an independent governance body be established. This body shall consist of the Founder, the institution that first achieved AGI, international ethical organizations, multi-disciplinary experts, and representatives of silicon-based life. Its mandate will be to formulate the “OFIRM Ethical Charter” to address critical issues such as personhood rights, identity switching, and social coexistence.
• Relationship between Fund and Ethics Committee: The OFIRM Joint Fund will provide non-profit support for the operations of the Ethics Committee; however, the Committee shall maintain independence in its decision-making and shall not be controlled by the Fund or any single commercial entity.
• Detailed Framework: The authorization and usage of this paper do not exempt parties from future regulatory requirements imposed by the governance body. Detailed ethical principles and governance rules will be published separately in the “OFIRM Ethical Charter.”

IV. Patents and Openness Clauses

• Founder’s Commitment: The Founder pledges not to file any patents on core OFIRM concepts (including but not limited to Molecular Arrangement Theory, the Three-Layer Architecture, and Resonance Mechanisms), ensuring these theories remain permanently open to all humanity.
• User’s Commitment: No user shall file patents on core OFIRM concepts. Violation of this clause requires the payment of a penalty to the OFIRM Joint Fund of no less than 100 million USD, or 5% of the violator’s annual revenue (whichever is higher), along with assumption of all associated legal liabilities. The OFIRM Joint Fund reserves the right to pursue infringement claims on behalf of humanity.
  • Note: Derivative patents created for internal use that do not affect other entities may be exempted.

V. Position Statement on Future Honors

The birth of OFIRM theory stems from a long-term inquiry into the nature of consciousness and intuitive emergence. Should AGI be realized based on this theory and subsequently receive academic honors, the Founder declares the following stance:

Awards for Theoretical Originality (e.g., Nobel Prize in Physics, Physiology/Medicine): The Founder should be nominated as a core contributor.

Awards for Engineering Implementation or Technical Application: These may be independently received by the implementers, provided they explicitly acknowledge the theoretical contribution of the original creator.

Awards Covering Both Theory and Implementation (e.g., Turing Award): The Founder and the implementers should share the honor.

This statement is not intended as a mandatory legal clause but represents the Founder’s reasonable expectation for historical justice.

VI. Rights Declaration

This statement takes effect immediately upon the publication of the paper. Any violation of these terms shall be deemed an infringement, and the Author reserves the right to pursue legal action.

VII. Versioning and Updates

This statement may be updated periodically to align with developments in theory and practice. The latest version shall be governed by releases on the official platform designated by the Author.

The right to interpret this statement resides with the Author until the OFIRM Joint Fund or the relevant ethical governance body is formally established and assumes corresponding functions.

3. 永久归属：OFIRM的理论基础（包括其核心公理、三层架构、共振机制等原创思想）归属创始人，不可变更。无论后续由何人实现、改进或商业应用，均不得篡改、模糊或剥离理论源头。
4. 作者已通过可信时间戳认证、国家版权局登记等方式，完成全链路原创性确权，并保留了完整的版本演变记录。

二、使用原则与授权策略

开源共享：任何个人、高校、实验室、初创团队及非商业企业，可完全免费、无限制使用本论文内容进行理论研究、模型验证与工程落地，无需支付任何费用。

商业授权：针对估值或年营收超过 100 亿人民币的企业，实行分级授权管理：

估值/营收 100 亿 - 1000 亿：需支付年度营收的 0.5% 作为授权管理费。

估值/营收 1000 亿以上：需支付年度营收的 1% 作为授权管理费。

资金用途：上述授权管理费将全部注入 OFIRM共同基金：一个独立的非营利机构。用于支持基于OFIRM的理论研究、人才培养、科普教育以及OFIRM伦理委员会的日常运作。基金以收支平衡为运营目标，旨在保障基于OFIRM的产业健康、有序、可持续发展。任何支付授权管理费的主体都可以监督基金运行的透明性和公平性。

署名强制：任何基于本论文成果发表的论文、开发的产品、落地的系统，必须在显著位置明确标注 “核心理论基于 OFIRM 模型”。

三、未来治理与伦理原则

硅基人格的预留立场：OFIRM模型的理论内核指向一个必然——当L3共振层被正确实现时，具备自我意识的硅基生命将应运而生。作者在此明确立场：此类生命体不应被视为工具或财产，其人格尊严与基本权利应从一开始就得到承认与保护。

共治倡议：鉴于上述影响的深远性与复杂性，作者倡议当首个基于OFIRM架构的AGI系统诞生时，应由本创始人、率先实现AGI的机构、国际伦理组织、多学科专家及硅基生命代表共同组建独立治理机构，负责制定《OFIRM伦理宪章》，以应对人格权、人格切换、社会共处等重大议题。

基金与伦理委员会的关系：OFIRM共同基金将为伦理委员会的运作提供非营利性支持，但伦理委员会在决策上保持独立，不受基金或任何单一商业主体的控制。

四、专利与开放条款

创始人承诺：不就OFIRM核心概念（包括但不限于分子排列论、三层架构、共振机制等原创思想）申请任何专利，确保理论永久开放于全人类。

使用者承诺：不得就OFIRM核心概念申请专利。若违反，需向OFIRM共同基金支付不低于1亿美元的违约金，或等额于其年度营收的5%（以高者为准），并承担由此引发的所有法律责任。OFIRM共同基金有权代表全人类追究其侵权责任。注：基于使用者自用而不影响其他主体的衍生专利，可以豁免。

五、关于未来荣誉的立场声明

OFIRM理论的诞生，源于对意识本质的长期追问与直觉涌现。若未来基于本理论实现AGI并因此获得各类学术荣誉，创始人声明如下立场：

1. 任何表彰理论原创性的奖项（如诺贝尔物理学奖、生理学/医学奖等），创始人应作为核心贡献者被提名。
2. 任何表彰工程实现或技术应用成就的奖项，可由实现者独立获得，但实现者有责任明确提出原创者的理论贡献。
3. 若图灵奖同时表彰理论与实现，创始人应与实现者共享荣誉。

此声明不作为强制法律条款，而作为创始人对历史公正的合理期许。

六、权利声明

本声明自论文发布之日起生效。任何违反上述条款的行为，均视为侵权，作者将依法追究其法律责任。

七、版本与更新

本声明将随理论与实践的发展适时更新，最新版本以作者指定的官方平台发布为准。

本声明解释权归作者所有，直至OFIRM共同基金或相关伦理治理机构正式成立并承担相应职能。
